In doing so, you officially accept all the present general conditions. The contract of sale is only finalised once it has been confirmed by the buyer’s payment. Allergoshop reserves the right to refuse an order or to subject it to further conditions such as in the case of large orders, incomplete order procedures or problems during previous orders. In this case, you will be informed by telephone or mail within 24 hours. Responsibility When making an order, you declare yourself to be over 18 years of age and your responsibility for the purchase. Payment Online payment via Ogone e-Commerce. Allergoshop has entrusted its payment system to Ogone e-Commerce, a Belgian company which specialises in 100% secure online payments. You may pay with Visa, Mastercard or Bancontact. Ogone e-Commerce is protected by various firewall systems and SSL 128 bit encryption. As a result, the validity of access rights – at the moment of your payment by bank card – is automatically verified and all information exchanges are encrypted in order to guarantee confidentiality. The exchange of sensitive information – like your credit card number – happens between the client and Ogone e-Commerce’s 100% secure site. Allergoshop or undesired visitors do not have access to this information. At the moment at which your credit card number is recorded, you will no longer be connected to our servers but to the protected servers of Ogone e-Commerce. The Ogone e-Commerce site has a certificate granted by Verisign. Following the processing of your card details and the acceptance of the payment, you will receive an online payment confirmation by e-mail. Delivery We deliver all our products to your home (or to any delivery address that you indicate) by Taxipost. The parcel is personally delivered to the addressee (or, in his/her absence, to a responsible adult considered as a member of the family) by the postman. However, if the addressee has a reception, the delivery will be left there (if you have your parcel delivered to your office or in a company, for example) Not at home when the postman comes? Not a problem. The postman will leave a card in your letter box which gives the location of the Taxipost depot where the parcel will be held. You then have 15 working days (not including the day of attempted delivery) to pick up the parcel or you can contact Taxipost and request for the parcel to be: • either resent to the initial address given, even on Saturdays. • or resent to another addresse of your choice (parents, neighbours, office,..) on the condition that this address is not further from the depot than the initial address (in general, this means that the second address must be in the same province as the first). • or sent to a post office near to you where you can pick it up yourself. See http://www.post.be/site/fr/postoffice/address/index.html to find your closest post office and to see its opening hours. Please note that every post office is open later 1 day per week so that you can potentially go there to collect your parcel after work. Delivery Incorrect delivery addresses are the responsibility of the client and can lead to additional charges being incurred (for example, the cost of resending the merchandise). In the event of errors in the address supplied by the addressee, the vendor can in no way be held responsible for the impossibility of delivering the ordered products. Situations of force majeure, whereby the vendor is relieved of its duty to deliver are as follows: war, rioting, fire, strikes, accidents and impossibility of supply. If the need arises, the client will, in all cases, be reimbursed. Loss or damage during transportation In accordance with the law on commercial practices, the loss of and/or damage suffered by an ordered product is chargeable to the vendor. The client is responsible vis-à-vis the vendor for the verification of the merchandise received. In the event of potential damage, the reimbursement or the replacement of the merchandise can only take place following its immediate return at the moment of receipt. By signing the notice of receipt, the client declares him/herself to be satisfied with the merchandise received and cannot then demand the reimbursement or replacement of the merchandise. Cooling-off period The Belgian law of 14th July 1991 on commercial practices and the information and protection of the consumer gives the buyer the authority to inform the vendor with 7 working days following the delivery of the product that he/she wishes to cancel the sale. The products must then be sent back within 5 working days following this notification. In this case, the buyer must ensure that the products are returned to Allergoshop intact, unused and sealed in their original packaging. Allergoshop can refuse or not reimburse returned articles if the packaging has been opened or if the articles have been damaged by the client. The costs of returning merchandise are payable by the client. Un- or badly labelled deliveries are always refused and returned to sender. We advise you to use a reputable courier service. Allergoshop can never be held responsible for the loss of returned merchandise. We will reimburse your order within 15 working days. Guarantees Insofar as the conditions and the scope of this guarantee permit it, Allergoshop will, in all cases, limit its intervention to the replacement of defective items or to the reimbursement of the price paid without the client being able to claim more extensive compensation. Allergoshop can never be held responsible for the non-fulfilment of a deliverer’s obligations in the matter of the execution of the guarantee, for example in the event of the bankruptcy of the deliverer. Allergoshop is not responsible for loss or material or other damage, of whatever nature, suffered by the client or a third party during the use of the merchandise. Complaints All complaints can be communicated by e-mail to info@allergoshop.be and will be dealt with within 5 working days. Lawsuits relating to the conclusion, the validity, the interpretation or the execution of the contract of sale or the present general conditions are subject exclusively to Belgian law and the exclusive authority of the Brussels district courts.
